How San Diego Landlords Can Document Relocation Payments

A relocation payment creates two problems at once. The tenant needs the funds on time, and the owner needs a clean record that the obligation was handled correctly.

San Diego relocation assistance is not the same as a security deposit. Under Municipal Code section 98.0706, a covered no fault termination generally carries a direct payment equal to two months of actual rent, or three months for a senior or disabled tenant. The owner can instead waive rent, but the choice needs to be documented correctly.

Build the File Before the Notice Goes Out

Owner Records

Keep the lease, notice, calculation worksheet, exemption review, payment election, and signed escrow instructions together. If the senior or disabled rate applies, confirm how that qualification was documented.

Tenant Records

Record each tenant or household receiving assistance, the amount, the release date, and any receipt. When several people are on one lease, make sure the payment record matches the lease and the written instructions.

What Each Record Proves

Record Why It Matters
Termination notice Establishes the starting point for the assistance timeline.
Assistance calculation Shows whether the payment is based on two months, three months, or a rent waiver.
Payee instruction Identifies who can receive funds and prevents an unsupported disbursement.
Proof of release Confirms the date and method after the funds leave the escrow account.

Common mistake: Treating a relocation payment as part of the deposit accounting. Municipal Code section 98.0706 states that required relocation assistance is in addition to the return of any deposit or security amount owed to the tenant.

Escrow adds a neutral payment trail, but the owner still needs legal counsel to confirm the notice and calculation. Our guide to relocation escrow documents explains what belongs in the payment file. Secured Trust Escrow then documents each verified funding and disbursement step.
